These terms govern sales and use of the Flonart SA website. By placing an order you confirm that you have read and accepted them without reservation.
Preamble
These general terms belong to Flonart SA, a company limited by shares registered under number CHE-192.956.496, whose registered office and shop Amir Rasty & Filles are located at 4, rue de Hesse, 1204 Genève, Switzerland.

Article 1 — Ordering on the site
We cannot be held liable for an order or a message not being received where incorrect data has been supplied, whether deliberately or not.
Article 2 — Availability
Our rugs are unique pieces: each reference exists in a single example. We take great care to display availability as accurately as possible. Discrepancies may nonetheless occur, in particular when a piece is sold in the shop at the same moment.
Should a product prove unavailable after your order has been accepted, we will inform you and refund the corresponding amount. Where an order covers several products, the remainder is dispatched within the stated time.
We may offer a replacement of similar quality, subject to your prior agreement. In that case we bear the shipping costs.
Article 3 — Prices and payment
3.1 — Displayed prices
Product prices are those shown on the site — or, for a purchase in the shop, those displayed in the shop. They are stated in Swiss francs, inclusive of all charges applicable in Switzerland, and exclude shipping costs and optional services.
Displayed prices may change, without effect on an order already accepted. Shop prices may differ from those on the site. Where the correct price of a product is lower than the price shown, we charge you the lower amount.
3.2 — Means of payment
You may pay by bank transfer or by credit or debit card. Card payments are processed by our provider Stripe; we retain no card data.
For bank transfers, our bank details are provided on order confirmation. Your order is held for seven (7) days pending receipt of the transfer.
For card payments, your account is debited once the order is complete and awaiting dispatch. Transactions are subject to validation by your card issuer; we are not liable for a refusal to authorise payment.
3.3 — Payment security
As part of anti-fraud checks, we may ask you by email for proof of address and/or a copy of valid identification. Failing receipt of these documents, or if they do not allow the person placing the order to be identified with certainty, we reserve the right not to accept the order.
We also reserve the right to refuse an order where a payment dispute is ongoing.
Article 4 — Retention of title
We retain full ownership of the items purchased until you have fulfilled all your obligations, in particular payment of the price in full.
Article 5 — Right of return
5.1 — Conditions
Returns must be made within fourteen (14) days of receipt. Return shipping costs are borne by the customer.
5.2 — Procedure
Returns are to be sent to: Flonart SA, 4, rue de Hesse, 1204 Genève, Switzerland. You are free to choose the method of dispatch and whether to insure the parcel against loss, theft or destruction; these costs remain yours.
Only products returned complete, in perfect condition, in their original packaging and with a return number will be accepted.
Refunds may be made by bank transfer or as a credit note. For exchanges, refunds are issued as a credit note only.
5.3 — Effects
Refunds are made within fourteen (14) days of the products being received by Flonart SA. Original shipping costs are not refunded, and return shipping costs remain yours.
Article 6 — Delivery
6.1 — Times
Delivery or collection is agreed between you and Flonart SA. Products are delivered or made available within the time stated on order confirmation or, failing that, within a maximum of sixty (60) days. This time cannot be guaranteed.
6.2 — Shipping costs
- Geneva and neighbouring communes: free delivery, no minimum order. This covers the whole canton of Geneva, as well as Céligny, Coppet, Founex, Mies, Tannay, Commugny, Chavannes-des-Bois, Bogis-Bossey, Crans-près-Céligny, Nyon and Prangins.
- Switzerland outside Geneva: CHF 15, free from CHF 300.
- European Union: CHF 25 up to CHF 250, CHF 35 from CHF 250 to 500, CHF 45 from CHF 500 to 700, CHF 55 from CHF 700 to 1,000, free from CHF 1,000.
- Rest of the world: CHF 40 up to CHF 250, CHF 50 from CHF 250 to 500, CHF 75 from CHF 500 to 700, CHF 95 from CHF 700 to 1,000, CHF 120 from CHF 1,000 to 1,500, free from CHF 1,500.
Shipments outside Switzerland. As Switzerland is not part of the European Union, every shipment abroad is an export. Any customs duties, taxes and clearance fees are borne by the recipient and are additional to the price paid on the site. Refusal of a parcel on those grounds gives no right to a refund of shipping costs.
6.3 — Duty to check
Risk passes to you on delivery. We strongly encourage you to open the parcel in the presence of the carrier to make sure nothing has been damaged.
Flonart SA is no longer liable for loss, damage, destruction or theft once the parcel has been delivered. In such cases, please contact the carrier directly within seven (7) days.
6.4 — Absence on delivery
If you are absent, you have seven (7) days to collect your parcel from the stated location. After that, the parcel is returned to us and the order is treated as cancelled, giving rise to a refund less shipping costs.
For deliveries by appointment, the carrier contacts you directly to agree a time. If you are unable to attend, you must notify us at least five (5) days before the agreed date.
6.5 — Collection in store (Click & Collect)
For products reserved in store, you have forty-eight (48) working hours from the confirmation email to collect your order. After that, Flonart SA reserves the right to put the product back on sale.
Article 7 — Warranties
7.1 — Product information
Although we describe products as accurately as possible, the details you see on screen — colour, pattern, texture — depend on your display. As our rugs are hand-knotted, stated dimensions are indicative and slight variations are inherent to craft production.
7.2 — Statutory warranty
Irrespective of any commercial warranty, Flonart SA remains liable for defects in the goods sold in accordance with articles 197 to 210 of the Swiss Code of Obligations.
7.3 — Certificate and appraisal
Every rug sold comes with a certificate of origin and an appraisal for your insurance. These documents attest to the provenance and value of the piece; they do not extend the statutory warranty.
7.4 — Defects not attributable to us
No warranty applies where the problem is caused by negligence, deterioration or improper use of the product.
Article 8 — Liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence. Subject to that, the liability of Flonart SA for its own acts or those of its auxiliaries is excluded to the extent permitted by law.
We cannot be held liable for network failures, computer viruses, bugs or damage caused to your equipment.
Article 9 — Miscellaneous
These terms form a whole and may not be amended without our express written consent. Failure to rely on a clause at any time does not amount to a waiver of the right to rely on it later. The invalidity of one clause leaves the others valid. You may not transfer or assign your rights or obligations.
These terms are governed by Swiss law. The parties expressly exclude the Vienna Convention on Contracts for the International Sale of Goods.
In a dispute with a consumer, the competent court is that of the user's domicile where proceedings are brought by Flonart SA, and that of the user's domicile or of Flonart SA where proceedings are brought by the user. Between businesses, any dispute not settled amicably within thirty (30) days is submitted to the courts of Geneva.
Article 10 — Use of the site
To use this site you must be of age or hold parental authorisation. It is your responsibility to ensure your equipment allows access. If you create an account, you undertake to provide accurate, complete and reliable information.
Your login credentials are confidential and you are responsible for all activity under your account. Notify us immediately of any unauthorised use. We reserve the right to suspend or delete access at any time.
We cannot guarantee continuous, uninterrupted or error-free operation of the site.
You may use the site for non-commercial purposes only. You may consult and print individual pages for personal use. Systematic extraction of content, storing it on a server, altering the site or interfering with its operation, and distributing unlawful, abusive or discriminatory content are prohibited.
The site collects no customer reviews. Reviews about the shop are published on third-party platforms, subject to their own terms.
Article 11 — Intellectual property
The general structure of the site and all its content — text, graphics, software, photographs, images, video, sound, trade marks and logos — are our exclusive property. We grant you a non-exclusive, revocable licence limited to consultation and browsing.
Any representation, reproduction or exploitation, in whole or in part, of the content or services of the site, by any means whatsoever, without our prior written authorisation, is strictly prohibited.

The site may include links to third-party sites. We are not responsible for their content or availability, and their presence implies no association with their operators.
